These terms govern your use of the CommentMine iOS application and related services ("the Service"), operated by CommentMine ("we", "us"). By creating an account you agree to them. If you do not agree, do not use the Service.

1. What the Service does

CommentMine connects to a YouTube channel you own, reads its public comments through YouTube API Services with read-only permission, and generates video idea cards, outlines, and reply drafts. The Service never posts, replies, or modifies anything on YouTube. Anything you choose to publish, you publish yourself.

2. YouTube and Google terms

The Service uses YouTube API Services. By using it you also agree to the YouTube Terms of Service. Google's Privacy Policy applies to Google's handling of your data. You can revoke CommentMine's access to your Google account at any time at myaccount.google.com/permissions.

3. Your account and eligibility

• You must be at least 13 years old (or the age of digital consent where you live) and able to enter a binding agreement.
• You may only connect a YouTube channel that you own or are authorized to manage.
• You are responsible for keeping your device and Google account secure.

4. Acceptable use

You agree not to use the Service to harass or target individual commenters, to scrape or redistribute comment data in bulk, to circumvent YouTube's terms, or to reverse engineer, overload, or interfere with the Service.

5. AI-generated content

Idea cards, outlines, and reply drafts are generated by machine-learning models from your viewers' comments. They are suggestions, not facts or advice. Quoted comments are reproduced verbatim from YouTube; everything else is a draft. You are solely responsible for reviewing anything before you act on it or publish it, and for complying with YouTube's community guidelines when you do.

6. Your data

How we collect, use, store, and delete data is described in our Privacy Policy, which is part of these terms. You can delete your account and all associated data at any time from Settings in the app.

7. Fees

The Service is currently provided free of charge. If we introduce paid plans, pricing and terms will be shown in the app before you are charged, and purchases will be handled through Apple's App Store.

8. Intellectual property

The Service, its software, design, and branding are owned by CommentMine. Comments belong to the people who wrote them and to YouTube under its terms. You may use the idea cards, outlines, and drafts the Service generates for you in your own creative work without restriction.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, CommentMine is not liable for indirect, incidental, special, or consequential damages, or for loss of revenue, views, or subscribers arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or US$50 if you paid nothing.

10. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms or YouTube's terms, or if YouTube API access becomes unavailable. On termination we delete your data as described in the Privacy Policy.

11. Changes

We may update these terms. We will change the effective date above and, for material changes, notify you in the app before they take effect. Continued use after that date means you accept the new terms.

12. Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Where local consumer protection law gives you additional rights, those rights are not affected.

1. 本服務的內容

CommentMine 連結你擁有的 YouTube 頻道，透過 YouTube API 服務以唯讀權限讀取公開留言，並產生影片靈感卡、大綱與回覆草稿。本服務絕不會在 YouTube 上發文、回覆或修改任何內容；任何你選擇發布的內容，都由你自行發布。

2. YouTube 與 Google 條款

本服務使用 YouTube API 服務。使用本服務即表示你同時同意 YouTube 服務條款；Google 對你資料的處理適用 Google 隱私權政策。你可隨時至 myaccount.google.com/permissions 撤銷 CommentMine 對你 Google 帳號的存取權。

3. 帳號與資格

• 你必須年滿 13 歲（或你所在地的數位同意年齡），且具備締結有效契約的能力。
• 你只能連結自己擁有或獲授權管理的 YouTube 頻道。
• 你須自行妥善保管裝置與 Google 帳號的安全。

4. 可接受的使用

你同意不利用本服務騷擾或針對個別留言者、不大量擷取或轉散布留言資料、不規避 YouTube 的條款，亦不對本服務進行逆向工程、超載或干擾。

5. AI 生成內容

靈感卡、大綱與回覆草稿是由機器學習模型根據觀眾留言生成，屬於建議，而非事實或專業意見。引用的留言是 YouTube 上的原文逐字重現；其餘皆為草稿。在採取行動或發布之前，你須自行審閱，並在發布時遵守 YouTube 社群規範。

6. 你的資料

我們如何蒐集、使用、存放與刪除資料，詳見隱私政策，該政策為本條款的一部分。你可隨時在 app 的「設定」中刪除帳號及所有相關資料。

7. 費用

本服務目前免費提供。若日後推出付費方案，我們會在收費前於 app 內顯示價格與條款，並透過 Apple App Store 處理購買。

8. 智慧財產權

本服務及其軟體、設計與品牌歸 CommentMine 所有。留言屬於撰寫者，並依 YouTube 條款歸屬 YouTube。本服務為你生成的靈感卡、大綱與草稿，你可不受限制地用於自己的創作。

9. 免責聲明與責任限制

本服務依「現狀」及「現有」提供，不附任何明示或默示的擔保，包括特定用途適用性。在法律允許的最大範圍內，CommentMine 不對因使用本服務而生的間接、附帶、特殊或衍生損害，或觀看數、訂閱數、收益之損失負責。我們對任何請求的總責任，以你在該請求前十二個月內支付給我們的金額為限；若你未曾付費，則以 50 美元為限。

10. 暫停與終止

你可隨時停止使用並刪除帳號。若帳號違反本條款或 YouTube 條款，或 YouTube API 存取無法取得，我們得暫停或終止該帳號。終止後，我們將依隱私政策刪除你的資料。

11. 變更

我們可能更新本條款。我們會更改上方的生效日期；重大變更會在生效前於 app 內通知你。該日期之後繼續使用，即表示你接受新條款。

12. 準據法

本條款以美國華盛頓州法律為準據法，不適用法律衝突規則。若你所在地的消費者保護法賦予你額外權利，該等權利不受影響。
